    SOFTWARE PRODUCT. here means Software, image files, all accompanying files, data and materials received with your downloaded or purchased software.

    This SOFTWARE PRODUCT. is for personal use only and may be installed and used by on only one device. Its component parts may not be separated for use on more than one device. SOFTWARE PRODUCT. may be accessed through a network only after obtaining a site license. All components accompanying the software are copyrighted by software owner and may not be taken apart, modified, used or published with other software or means except with the SOFTWARE PRODUCT. software and may not be distributed or copied in any manner.

    Any liability of Software Mall will be limited exclusively to refund of purchase price. In addition, in no event shall Software Mall, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of SOFTWARE PRODUCT.

    In addition, in no event does Software Mall authorize you to use this SOFTWARE PRODUCT in applications or systems where SOFTWARE PRODUCT 's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Software Mall harmless from any claims or losses relating to such unauthorized use.

    Purchase Policy
, Software Mall reserves the right to limit quantities of Software licenses purchased. Software licenses may be purchased only for the personal use of the individuals Downloading them or the internal business use of the organizations represented by such individuals. In no event may any Software be purchased for resale.

    Terms of Prices;Payment Terms;Authorization.
You agree to pay all one-time, annual, monthly and/or other periodic fees at the rates in effect when the charges were incurred. Payment can be done by deducting fee on pre-paid phone, PaySbuy account or bill at the month end for post-paid phone. For credit card payment, you agree to provide Software Mall with accurate and up-to-date credit card and contact information. Failure to comply may result in the immediate termination of this Software license. You authorize Software Mall to automatically bill all fees relating to your purchase of the Software license(s) to the credit card identified by you in the purchase process. Except as permitted by Software Mall's return policy as posted on the Website, all fees and charges are nonrefundable. All prices are as shown on the Website and may change at any time. Your rights under this Agreement shall begin immediately upon your downloading of the Software.

    Additional Terms for Subscription Software:
Subscription Fees; Cancellation; Billing Disputes; Modification of Subscription Terms; Email Notification.

	a. Subscription Fees. All subscriptions for Software will continue and renew automatically for so long as: (i) your subscription is in place and all applicable fees are timely paid, (ii) until you notify Software Mall of your decision to change or otherwise cancel your subscription renewal (as indicated below), or (iii) unless earlier terminated by Software Mall. Fees for subscription Software will be billed on a monthly, quarterly or annual basis as follows:
		i. Monthly Subscription Fee: Your monthly bill/ deducting pre-paid phone/ credit card will be charged at the time of purchase for your first month of use. After this initial payment, your credit card will be automatically charged on the same day of the subsequent month for the use of such Software, until you cancel your subscription. ii. Annual Subscription Fee: Your monthly bill/ deducting pre-paid phone/ credit card will be charged at the time of purchase for the entire annual subscription amount. You will receive an email notification thirty (30) days prior to your annual subscription expiration date that will give you the option to cancel your subscription. If no action is taken, your subscription will automatically renew for an additional one (1) year period.
	b. Cancellation. Except as otherwise set forth in this Agreement, you shall immediately discontinue use of the subscription product upon termination of this Agreement (whether by you or Software Mall). Your obligation to pay accrued charges and fees shall survive any termination of this Agreement.
		i. Cancellation by Software Mall. In the event you purchase subscription Software and payment fail or the credit card provided at the time of purchase is canceled or is otherwise terminated, you must immediately provide Software Mall with another valid credit card number or access to your subscription Software will cease. This Agreement will automatically terminate if you fail to comply with any of the terms of this Agreement. No notice shall be required from Software Mall to effect such termination. ii. Cancellation by You. You may cancel your subscription at any time by accessing your Software Mall Member Account. Cancellation instructions are available through the "Subscription Product" link on your account. You may also send a cancellation request via email to Software Mall's Customer Care department. In the event you signed up for a minimum commitment period, you will responsible for all charges for the entire minimum commitment period, regardless of your cancellation date. iii. Billing Disputes. You agree to notify Software Mall regarding any billing disputes within ninety (90) days after they have been charged. If any issues or disputes are not brought to Software Mall's attention within this timeframe, you waive your right to dispute them.
	c. Modification of Subscription Terms. Software Mall may modify the terms of subscription Software, including but not limited to the price, content or nature of the subscription, upon notice to you by email or by publishing the changes on the Website. Software Mall may provide notice to You by email or by publishing the changes on the Website. In the event that Softwaremall modifies the subscription terms of Software, you may terminate the Software license at any time and will be entitled to receive either: (i) continued use of the subscription Software for the remainder of the subscription period already paid or (ii) a pro-rata refund of the paid subscription amount.
	d. Email Notification. To let you know what new subscriptions are available from time to time, or to notify you of a charge to your account, Software Mall will send you email correspondence. You agree that as a subscriber, Software Mall may send you such email to the address you provide. You will receive this email even if you have opted out of receiving other email from Software Mall. If you do not want to receive this email, you may cancel the subscription at any time as provided in this Agreement.

    This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by Thai laws.

    Software Mall is the software distributor, software owner is the owner of the copyright of this SOFTWARE PRODUCT all of its derivatives, title and accompanying materials are the exclusive property of software owner. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by software owner. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this SOFTWARE PRODUCT. You may not make access to SOFTWARE PRODUCT available to others in connection with a service bureau, application service provider, or similar business, or use this SOFTWARE PRODUCT in a business to provide file compression, decompression, or conversion services to others.

    You may not disclose to other persons the data or techniques relating to this SOFTWARE PRODUCT. that you know or should know that it is a trade secret of software owner and/ or Software Mall in any manner that will cause damage to software owner and/ or Software Mall.

    This SOFTWARE PRODUCT. and all services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Thai laws is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Software Mall and/ or software owner harmless from any claims resulting from the use of this SOFTWARE PRODUCT, which may damage any other party.
